• Support regulatory compliance and incident prevention

3. User Accounts and Access

3.1 Account Registration

To access our Service, you must create an account with accurate, complete, and up-to-date information. You are responsible for safeguarding your account credentials and all activities under your account.

3.2 Authorized Users

You may only authorize employees and contractors who require access for legitimate workplace safety purposes. You are responsible for all activities of your authorized users.

You must immediately notify us of any unauthorized use of your account or any security breaches.

4. Acceptable Use

You agree to use the Service only for legitimate workplace safety monitoring purposes. You will not:

• Use the Service for surveillance beyond safety and compliance monitoring
• Attempt to identify specific individuals through the AI monitoring system
• Reverse engineer, decompile, or attempt to extract our AI algorithms
• Interfere with or disrupt the Service or servers
• Use the Service for any illegal or unauthorized purposes
• Share access credentials or allow unauthorized access

5. Data and Privacy

You retain ownership of all data you provide to the Service, including camera feeds and workplace information. Our use of your data is governed by our Privacy Policy.

Our AI systems process visual data to detect safety risks while maintaining privacy through anonymization techniques. We do not use your data to identify specific individuals.

6. Intellectual Property

PreemptEye retains all rights to our AI technology, software, algorithms, and platform. This includes all improvements and derivatives created through our Service.

You retain ownership of your workplace data and information. You grant us a limited license to process this data to provide the Service.

6.3 Feedback

Any feedback, suggestions, or improvements you provide may be used by PreemptEye without restriction or compensation.

7. Service Availability and Support

7.1 Uptime

We strive to maintain 99.9% service availability but do not guarantee uninterrupted access. Scheduled maintenance will be announced in advance when possible.

7.2 Support

Technical support is provided through our customer portal and includes assistance with setup, configuration, and troubleshooting.

8. Limitation of Liability

PreemptEye is a monitoring and alerting tool designed to enhance workplace safety. However:

• The Service is not a substitute for human safety oversight and judgment
• We cannot guarantee detection of all safety risks or prevent all incidents
• You remain responsible for maintaining a safe workplace and compliance with regulations
• Our liability is limited to the amount paid for the Service in the preceding 12 months

9. Indemnification

You agree to indemnify PreemptEye against claims arising from:

• Your use of the Service in violation of these Terms
• Your failure to maintain workplace safety despite system alerts
• Privacy violations or improper use of monitoring capabilities
• Your data or content that infringes third-party rights

10. Payment Terms

10.1 Fees

Service fees are based on your selected plan and usage. All fees are non-refundable except as required by law.

10.2 Payment

Fees are charged in advance on a monthly or annual basis. Payment must be made by credit card or approved payment method.

10.3 Late Payment

Late payments may result in service suspension. We reserve the right to charge interest on overdue amounts.

11. Termination

14. Dispute Resolution

Any disputes will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in Wilmington, Delaware.

15. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.

16. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.

17. Force Majeure

PreemptEye will not be liable for delays or failures due to circumstances beyond our reasonable control, including natural disasters, pandemics, or government actions.
